How Does Divorce Affect Immigration Status?
Divorce can significantly impact your immigration status, depending on the specific circumstances. If you are a conditional permanent resident, for example, you may lose your status if you get divorced. However, if you are a lawful permanent resident or a U.S. citizen, your divorce will not affect your immigration status.
That said, if you are a U.S. citizen or lawful permanent resident and are sponsoring your spouse for a green card, a divorce could affect your spouse’s immigration status:
- If you are a U.S. citizen and have been married to your spouse for less than two years, your spouse will receive a conditional green card. If you get divorced before the two-year period is up, your spouse will lose their conditional green card and may be subject to deportation.
- If you are a U.S. citizen and have been married to your spouse for more than two years, your spouse will receive a permanent green card. If you get divorced after your spouse has received a permanent green card, your spouse’s immigration status will not be affected.
- If you are a lawful permanent resident sponsoring your spouse for a green card, your spouse will receive a permanent green card. If you get divorced after your spouse has received a permanent green card, your spouse’s immigration status will not be affected.
- If you are a lawful permanent resident and have been married to your spouse for less than two years, your spouse will receive a conditional green card. If you get divorced before the two-year period is up, your spouse will lose their conditional green card and may be subject to deportation.
It is important to note that if you are a U.S. citizen or lawful permanent resident and are sponsoring your spouse for a green card, you must sign an Affidavit of Support. By signing this document, you are agreeing to financially support your spouse until they become a U.S. citizen or until they have worked for 40 quarters (10 years). If your spouse receives any means-tested public benefits, you may be required to repay the government for these benefits. You will also be required to support your spouse even if you get divorced.
For these reasons, it is important to consult with an experienced family law attorney if you are an immigrant considering divorce or a U.S. citizen or lawful permanent resident sponsoring your spouse for a green card.
